FRASER, The Honourable Robert P., QC

October 10, 1929 – March 25, 2013

The Hon. Robert P. Fraser, Q.C. was born on Thursday, October 10, 1929 and passed away on Monday, March 25, 2013. He is survived by his wife of sixty years, Jean Fraser, his daughters Kate Chisholm (Steve), Mary MacGregor and Betsy Fraser, his grandchildren Jesse, Ellen, Matt, Sam and Ben, sister-in-law Clemence Fraser and nephew Matt Fraser. R.P. was a devoted husband, a wonderful father, a loving granddad, a loyal friend, a very talented lawyer and a thoughtful and respected Justice of the Court of Queen’s Bench. The law was his lifelong interest and passion. Among many honours, R.P. served as President of the Ranchmen’s Club of Calgary (1979 – 1981), President of the Law Society of Alberta (1986 – 1987) and the Chair of the Saddledome Foundation (1991 – 1998).

A Memorial Service will be held at McINNIS & HOLLOWAY’S Park Memorial Chapel (5008 Elbow Drive S.W. Calgary, AB) Thursday, March 28, 2013 at 3:00 p.m. Condolences may be forwarded through www.mcinnisandholloway.com. His family is deeply grateful to the medical specialists and caregivers who made his last years easier.

    I am saddened today to note Bob’s passing. He was my respected partner at Fenertys for 23 years. I had not been aware that he has not been well of recent times. I recall that Bob and Jean were the first Fenerty persons that I met when I arrived in Calgary in 1962. I know that Jean and Bob were always close pals and it will be difficult for Jean as well as the daughters to adjust to Bob’s loss. Best wishes and my condolences to all of you.

    My note will be disproportionately long to my brief association with Mr. Justice Fraser, which was limited to only one encounter. But it was very impactful on me and I feel I should share it quickly to pay my respects to a great judge and human being. My apologies in advance for its length.
    I was a very young lawyer in the early 1990s and was toiling at a small firm in Calgary after my first firm folded two years into my career. This was not to my liking for several reasons, chief among them the fact that my new firm was not able to provide me with the regular mentoring that I longed for. One day, I was given a difficult assignment in a new area that involved complex facts and legal issues, well above my ability at the time to figure out. As I struggled late one night reaching one mental impasse after another, I recalled that the Court of Queen’s Bench assigned Duty Judges who, I was told, might help answer questions or at least provide some guidance. I called the Court the next day and my call was placed through to Mr. Justice Fraser. I had never met him, but I knew he had recently been appointed to the Bench. I apologized for bothering him and proceeded to explain my problem to him, fully expecting to get a brush off or a trite, half-hearted “answer” from a busy and important judge. I was pleasantly surprised to receive several thoughtful questions from Mr. Justice Fraser, who I could tell was not only listening to my description of the situation but was also very sympathetic to my plight. Once he was sure he fully understood the facts, he then promised to canvas his colleagues on the Bench and get back to me. Again, I had my doubts as it sounded too good to be true. But over the coming days, he called me several times to confirm the facts and ultimately provide me with his advice. He quite properly didn’t solve my problem for me but did provide me with the clear direction that I needed to proceed forward to complete the matter with confidence for a grateful client. I was so grateful for his beyond-the-call-of-duty assistance that, in my desire to thank him, I naively sent him a box of Callebaut chocolates. Of course, he returned them to me with a short thank you note, advising that as a member of the Bench he could not accept gifts. In part because if Mr. Justice Fraser’s example through this – my only – encounter with him, I love to mentor junior lawyers now that I have some grey legal hair of my own. And he provided this solicitor with a deeper respect for the legal profession and the Bench that endures to this day.
    My sincere thanks once more to Mr. Justice Fraser and my condolences to his family, who I imagine must be missing him terribly.

Bob was an integral part of the “Fenerty Firm”–including Buzz Fenerty, Bill McGillivray, Jack Robertson, Bill Brennan, Cliff and Hubert Prowse, and others–who inspired so many young law graduates.
